Welcome to myNaturevista. These Terms of Service govern your access to and use of our SaaS platform, including our website, dashboard, APIs, and embeddable widgets (collectively, the "Service").
We reserve the right to update these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Eligibility and Account Registration

To use our Service, you must:

- Have the legal capacity to enter into binding contracts

- Not be prohibited from using the Service under applicable laws

When creating an account, you must:

- Be responsible for all activities under your account
- Immediately notify us of any unauthorized access or security breaches
3. Description of Service
myNaturevista provides a SaaS platform for distributing natural places and tourism content through embeddable widgets. Our Service includes:
- Widget embedding technology for websites
- API access for programmatic integration
- Custom place management and content curation
- Usage analytics and reporting dashboard
- Multi-domain support (plan-dependent)
- Customer support services
4. Subscription Plans and Billing
4.1 Subscription Tiers
We offer three subscription plans:

4.2 Billing Terms
- Billing Cycle: Subscriptions are billed monthly in advance
- Payment Method: All payments processed securely through Stripe
- Currency: Prices listed in Euros (€) unless otherwise specified
- Automatic Renewal: Subscriptions automatically renew unless cancelled
- Failed Payments: Service may be suspended after 3 failed payment attempts
- No Refunds: Subscription fees are non-refundable except where required by law
4.3 Usage Limits
- Widget Openings: Monthly limits apply per your subscription plan
- API Rate Limiting: 100 requests per 15 minutes per API key
- Custom Places: Limited by your subscription plan
- Overage: Exceeding limits may result in service throttling or suspension
4.4 Subscription Changes
- Upgrades: Take effect immediately; you are charged the prorated difference
- Downgrades: Take effect at the next billing cycle
- Cancellation: You may cancel anytime; access continues until the end of the current billing period
5. API Keys and Security
5.1 API Key Management
- You are responsible for securing your API keys
- API keys are unique identifiers for accessing our Service
- Do not share, publish, or expose API keys publicly
- Immediately rotate keys if compromised
5.2 Domain Validation
- API keys are restricted to approved domains in your account
- You must register all domains where widgets will be embedded
- Domain verification may be required
- Subdomains of registered domains are automatically allowed
6. Acceptable Use Policy
6.1 Permitted Use
You may use our Service only for lawful purposes and in accordance with these Terms. Our platform is designed for sharing natural places and tourism content suitable for all audiences.
6.2 Prohibited Content
You may NOT upload, share, or display content that:
- Is sexually explicit, pornographic, or obscene
- Contains graphic violence or disturbing imagery
- Promotes hate speech, discrimination, or harassment
- Is denigrating, defamatory, or harmful to minors
- Contains malware, viruses, or malicious code
- Infringes intellectual property rights
- Violates any applicable laws or regulations
- Is fraudulent, misleading, or deceptive
- Promotes illegal activities
6.3 Prohibited Activities
You may NOT:
- Use the Service for any unlawful purpose
- Attempt to bypass security measures or access controls
- Reverse engineer, decompile, or disassemble our Service
- Scrape, crawl, or harvest data without authorization
- Interfere with or disrupt the Service or servers
- Impersonate any person or entity
- Resell or redistribute the Service without authorization
- Exceed rate limits or attempt to overwhelm our systems
7. Intellectual Property Rights

The Service, including all content, features, software, designs, logos, and trademarks, is owned by myNaturevista and protected by intellectual property laws.
7.2 Your Content
You retain ownership of content you upload ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely to provide and improve the Service.
You represent and warrant that:
- You own or have rights to your User Content
- Your content does not infringe third-party rights
- Your content complies with these Terms
8. Data and Privacy
8.1 Privacy Policy
Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you also agree to our Privacy Policy.
8.2 Data Processing
- We act as a data processor for widget visitor data
- You act as the data controller for visitors to your website
- You must have appropriate privacy notices and consents for your website visitors
- You are responsible for compliance with privacy laws (GDPR, CCPA, etc.) regarding your visitors
9. Service Availability and Modifications
9.1 Service Availability
We strive to provide reliable, uninterrupted Service, but we do not guarantee 100% uptime or availability. We may temporarily suspend the Service for maintenance or security updates.
9.2 Service Modifications
We reserve the right to modify, update, or discontinue features with reasonable notice to users.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and security.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
11.2 Liability Cap
Our total liability for all claims shall not exceed the greater of: (a) €100, or (b) the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless myNaturevista from any claims, liabilities, damages, losses, and expenses arising from:
- Your violation of these Terms
- Your violation of any laws or regulations
- Your User Content or use of the Service
- Your infringement of third-party rights
13. Termination
13.1 Termination by You
You may terminate your account at any time through your dashboard settings. Upon termination, access ends at the end of your billing period with no refunds for partial months.
13.2 Termination by Us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activities, or pose a security risk.
13.3 Effect of Termination
Upon termination, your API keys will be deactivated, widgets will stop functioning, and your data will be deleted per our retention policy.
14. General Provisions
14.1 Governing Law
These Terms are governed by the laws of Belgium, without regard to conflict of law principles.
14.2 Entire Agreement
These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and myNaturevista.
